1. Introduction
These Terms and Conditions govern your use of services provided by CLOUD HIVE DC LTD. By accessing our website or purchasing our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.
These Terms apply to all hosting services: Dedicated Servers, VPS, Game Servers, AI/GPU Servers, Storage, and Web Hosting.
2. Definitions
For the purpose of these Terms:
- Service — Any hosting service or infrastructure provided by CLOUD HIVE DC.
- Content — Data, files, and applications stored on our services.
- SLA — Service Level Agreement specifying uptime guarantees.
- AUP — Rules governing permitted use (Section 8).
3. Service Level Agreement
Uptime Guarantees
- Dedicated Servers / VPS: 99.9%
- Game Servers / AI Servers: 99.5%
SLA Credits: If we fail to meet the stated uptime guarantee, you may be eligible for service credits ranging from 10% to 50% of the monthly fee, depending on the duration of the outage. Credits must be requested within 30 days of the incident.
4. Account Registration
You must provide accurate and complete information when registering an account and keep it up to date. We reserve the right to verify your identity when requested.
We use automated fraud detection systems. New orders may require identity (ID) or address verification before activation.
5. Billing and Payments
Services are billed in advance. Setup fees are due immediately upon order. We accept the following payment methods: Cards, PayPal, Cryptocurrency, and SEPA bank transfer.
Late Payments: Services may be suspended after 7 days of non-payment and permanently terminated after 30 days.
Refunds: Individual consumers (B2C) have a 14-day right of withdrawal under the Consumer Contracts Regulations 2013, unless immediate service activation has been requested and the service has been fully performed. Business customers (B2B) have no statutory right of withdrawal. Please refer to our Refund Policy for full details.
6. Data Protection
We are committed to protecting your personal data in accordance with the UK Data Protection Act 2018 and the UK GDPR.
For account and billing data, CLOUD HIVE DC LTD acts as the Data Controller. For any personal data you store on your server or service, we act as the Data Processor on your behalf.
7. Customer Responsibilities
You are solely responsible for:
- Maintaining the confidentiality of your account credentials and passwords.
- Keeping your server software and applications up to date.
- Maintaining regular backups of all your data.
- Any and all content you host or transmit using our services.
8. Acceptable Use Policy
You agree not to use the Services for any unlawful or prohibited purpose. The following activities are strictly forbidden:
- Cryptocurrency Mining — without prior written approval.
- Spam and Mass Emailing — unsolicited bulk communications.
- Network Abuse — including DDoS attacks, port scanning, and operation of botnets.
- Illegal Content — including phishing, malware distribution, DMCA-infringing material, and CSAM.
We reserve the right to audit usage and request KYC (Know Your Customer) documentation at any time.
9. Suspension and Termination
We may suspend your service immediately and without notice for violations of the Acceptable Use Policy or for non-payment of invoices.
You may terminate your services at any time by providing 30 days' written notice through your client portal.
Upon termination, all data stored on terminated services will be permanently deleted within 30 days. We strongly recommend downloading all your data before initiating termination.
10. Limitation of Liability
- Our total aggregate liability to you is limited to the total amount you paid to us in the 12 months preceding the event giving rise to the claim.
- We are not liable for any indirect, incidental, or consequential damages, including loss of profits or loss of data.
- Our services are provided "as is" without warranties of any kind, except as required by applicable law.
11. Consumer Rights
If you are a consumer (an individual not acting in the course of a business), you have additional rights under the Consumer Rights Act 2015.
In particular, our services must be provided with reasonable care and skill. Nothing in these Terms affects your statutory consumer rights.
12. Intellectual Property
CLOUD HIVE DC LTD retains all intellectual property rights in our website, infrastructure, software, and branding.
You retain full ownership of all content and data you upload or store on our services. You grant us a limited licence solely to provide the services to you.
13. Dispute Resolution
In the event of a dispute, we encourage you to contact us first by raising a support ticket. We will endeavour to resolve all disputes amicably within 14 days.
If a dispute cannot be resolved informally, it may be referred to mediation or to the courts of England and Wales.
14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
You agree to submit to the exclusive jurisdiction of the courts of England and Wales.
15. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control.
Such causes include, but are not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power failures, or internet backbone disruptions.
16. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time. We will notify you of material changes by email or by posting a notice on our website.
Your continued use of our services following the effective date of any changes constitutes your acceptance of the revised Terms.
